Enter your last day and how the job ended. The calculator applies the Montana deadline, tells you how many days late the payment is, and estimates the possible late-pay penalty. It runs in your browser — nothing is sent to us.
The deadline is the statutory maximum in Montana: Unpaid wages are due 15 days from the separation date, or on the next regular payday for that pay period, whichever comes first (Mont. Code § 39-3-205). Resignation falls under the same rule: 15 days from separation or the next regular payday, whichever is earlier (Mont. Code § 39-3-205). The penalty estimate uses Montana provides a penalty for failure to pay at the time required (§ 39-3-206), but the statute does not set a formula that can be computed from the wages alone; the amount is determined in the proceeding.
This is an estimate, not a legal determination. Penalty provisions usually depend on the employer acting wilfully, and a court or agency decides the final number. Use the result to decide whether to send a demand, not as a promise of what you will collect.
