Enter your last day and how the job ended. The calculator applies the Virginia deadline, tells you how many days late the payment is, and estimates the possible late-pay penalty. It runs in your browser — nothing is sent to us.
The deadline is the statutory maximum in Virginia: On termination of employment the employee must be paid all wages due for work performed, on or before the date the employee would have been paid had employment continued (Va. Code § 40.1-29). Resignation follows the same rule: wages for work performed are due on or before the date you would have been paid had you stayed. The penalty estimate uses Virginia does not add a liquidated-damages formula for the employee. § 40.1-29 instead provides civil penalties payable to the Commonwealth, back-wage restitution ordered by the Commissioner or a court, and the Commissioner's power to investigate and issue subpoenas.
This is an estimate, not a legal determination. Penalty provisions usually depend on the employer acting wilfully, and a court or agency decides the final number. Use the result to decide whether to send a demand, not as a promise of what you will collect.
